Terms of Service

The service

Madison Point plans your social media calendar. It drafts a period of captioned entries, grounded in your own photos and catalog, and gives you a calendar to work: approve an entry, edit it, skip it, or ask for a fresh take on its caption. Madison Point doesn’t post for you. It plans the month, writes the captions, and keeps the calendar; you publish from your own account and mark it done.

Your account

You’re responsible for keeping your sign-in credentials secure, for the accuracy of what you tell us about your business, and for what you approve and share to Instagram or Facebook yourself, including your own compliance with those platforms’ rules. You may add other users to your account under an owner or staff role; you’re responsible for what they do with the access you give them.

Your content

Your photos, your menu or service list, and any notes you give us stay yours. By using the product you grant us a limited license to store, process, and show that content back to you as part of the service, and to send the specific pieces described in our Privacy Policy to the vendors named there, for the purposes stated there and for no other purpose. You confirm you have the right to give us what you upload.

Acceptable use

You agree not to:

• Upload anything you don’t have the rights to use.
• Upload anything illegal, or content that infringes someone else’s rights.
• Try to disrupt the service, bypass its usage limits, or reach another account’s data.
• Impersonate another business or person.

Billing

Some accounts are billed on a recurring subscription through Stripe. You can cancel at any time by emailing us at hello@madisonpoint.co; we don’t offer refunds for a partial billing period unless we say otherwise in writing. (That refund policy is a business decision, not a fact drawn from the code — flagged here for counsel to confirm before this page goes live to a real customer.)

Availability and no warranty

We aim to keep the service available, but we don’t guarantee it will be uninterrupted or error-free. Generating a set of options calls a third-party AI model more than once; sometimes fewer of those calls succeed than we need, and the request fails outright rather than handing back a broken result. The service is provided “as is,” without warranties of any kind, to the extent the law allows.

Limitation of liability

To the extent the law allows, Madison Point isn’t liable for indirect, incidental, or consequential damages arising from your use of the service, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Changes to these terms

We may update these terms from time to time. We’ll change the date at the top of this page when we do; continuing to use the service afterward means you accept the update.

Governing law
